In my final divorce from 2010, it states that my former husband can claim our eldest son as a tax dependency exemption. He’s not listed on my taxes as a dependent but my accountant years ago listed him for earned income credit since both children live with me.

He’s now claiming I filed incorrectly and is suing me to pay his back taxes.
