My son was 19 in 2015. He started his second semester at college in January 2015, living on campus, but withdrew from classes and returned home in February 2015.


My son was 19 in 2015. He started his second semester at college in January 2015, living on campus, but withdrew from classes and returned home in February 2015. He was still considered enrolled and could have started classes again if we had been able to pay for the tuition (he lost scholarships and grants due to poor grades in his first semester).

Can we still claim he was a student for 2015 and thus claim the EIC on our taxes this year?

Unfortunately not. In order to be considered a student, he must have been a full time student for part of five months during the year. Since he does not meet this criteria, you cannot claim the EIC for him. In addition, unless his gross income was under $4,050, you can't claim him as a dependent.
